The Staff Exclusion List (SEL) contains names of those who have committed serious or repeated acts of abuse or neglect against people with special needs in programs under the Justice Center's jurisdiction.
Chapter 422 of the Laws of 2017 amended section 491 of Social Services Law to require that every facility or program under the jurisdiction of the Justice Center must have policies and procedures in place to identify and report possible crimes against a student by a custodian to local law enforcement.
The guidance outlines expectations relating to the performance of an immediate protections safety assessment and informs residential schools of an immediate protections safety assessment template that will be utilized by the New York State Education Department's Incident Management Unit.
The information provides guidance on incidents that mandated reporters must report to the New York State Justice Center for the Protection of People with Special Needs (Justice Center) if they have reasonable cause to suspect that a reportable incident occurred, either by directly witnessing an incident or by being told about it.
The purpose of this memorandum is to provide information to residential schools on the requirements pertaining to standards for the protection of both day and residential students who attend residential schools governed by the New York State Education Department against abuse, neglect and other conduct that may jeopardize their health, safety and welfare.
